Legal Notice on Terms and Conditions of Participation

PIA UDG is giving away an Accessibility Check as part of DMEXCO 2024.  

The following terms and conditions govern the participation in and execution of the contest for an Accessibility Check as part of DMEXCO 2024. By participating in the contest, participants accept the following terms and conditions and agree to the terms of participation and data protection conditions.

1. Contest Process  

The contest will run from September 1, 2024, to September 30, 2024. During this period, participants will have the opportunity to enter the contest (online or at DMEXCO 2024).

2. Eligibility  

All individuals aged 18 and over and business customers are eligible to participate. Companies are eligible to participate, and participation can be carried out by authorized employees or representatives of the company.  

Individuals involved in the design and implementation of the contest and employees of the organizer, as well as their family members, are not eligible to participate.  

The organizer reserves the right to exclude individuals from participation at any time at its discretion, especially for the following reasons:  

   (a) manipulation or attempts to manipulate the entry process or the execution of the contest,  

   (b) violation of these terms and conditions,  

   (c) unfair conduct, or  

   (d) false or misleading information related to participation in the contest.

3. Participation in the Contest  

To participate in the contest, the entry form provided (available at https://www.udg.de/win-an-accessibility-audit or from PIA UDG staff at the DMEXCO 2024 booth) must be fully completed and submitted. All information must be truthful.  

Each participant is only allowed to enter the contest once. Multiple entries will be excluded. The organizer reserves the right to disqualify participants who enter the contest multiple times. If multiple participants enter on behalf of a company, only one entry for the company will be considered.  

Participation is only possible during the contest period. Late entries will be excluded.  

Participation in the contest is free of charge.

4. Prize, Notification, and Delivery of the Prize  

The prize is a free Accessibility Check of the company's website or app. The audit will be provided as a full-service offering by PIA UDG experts, including a results report and recommendations for action.  

The winner will be determined by a random draw.  

The winner will be notified by email or phone. If participants enter on behalf of a company, the company will be considered the winner of the contest. In such a case, the winner notification will be sent to the email address or phone number provided by the participant. The winner must confirm within 7 days of notification whether they accept the prize. If the winner does not accept the prize within this period, the organizer reserves the right not to award the prize.  

The claim to the prize expires no later than 4 months after notification of the prize.  

An exchange or cash payment of the prize is excluded.  

The winner is responsible for any tax obligations related to the prize.  

There are no costs for the winner related to the provision of the prize.

5. Liability  

The organizer accepts no liability for problems that may arise during the execution, determination, and delivery of the contest, particularly for any technical issues, such as problems in filling out the entry form.  

The organizer also assumes no liability for defects in the prize.  

The organizer reserves the right to terminate the contest at any time and without prior notice and without stating reasons.

6. Data Protection Notice  

Participation in the contest requires the provision of personal data. The following data will be processed by the organizer:  

  • Name  

  • First Name  

  • Position  

  • Company Name  

  • Address  

  • Email Address  

The data will be processed to administer the contest, particularly to notify the winner. Furthermore, the data will be processed for marketing purposes, such as sending newsletters, invitations to company events, trade shows, and surveys.

Consent to the processing of data can be revoked at any time. After revocation of consent, the data will be promptly deleted.  

The data will be irreversibly deleted no later than four weeks after the end of the contest.

7. Applicable Law, Severability Clause  

Should any provision of these Terms and Conditions of Participation and Data Protection be invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, a provision that comes closest to the intent of the organizer within the legally permissible scope shall apply. The same applies in the case of a regulatory gap.  

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The decision of the court is final.
